1. Acceptance of These Terms

These Terms of Service, together with our Privacy Policy and any order or plan details presented to you at sign-up (collectively, the “Terms”), form a binding agreement between you (“Customer,” “you,” or “your”) and Curb Critter LLC, a Florida limited liability company (“Curb Critter,” “we,” “us,” or “our”). By creating an account, purchasing a plan, or using our website or services, you agree to these Terms. If you do not agree, do not sign up for or use the Services. You must be at least 18 years old and have legal authority to enter this agreement.

2. Description of Services

Curb Critter provides the following residential subscription services within our active service area (currently Sarasota County and Manatee County, Florida):

  • Bin Valet: rolling your trash and/or recycling bins to the curb ahead of your municipality’s scheduled collection and returning the emptied bins afterward on each scheduled collection day.
  • Bin Cleaning: sanitizing and deodorizing your bins, performed once per billing period, as a distinct add-on service.
  • Valet + Clean Bundle: Bin Valet and Bin Cleaning together, billed as a single combined plan.

Curb Critter does not remove household trash, collect loose bags outside a bin, or act as a waste hauler. Plans include up to two (2) bins; additional bins are billed at the rate shown at sign-up.

3. Plans, Pricing & Payment

Current pricing is displayed at CurbCritter.com and confirmed before checkout. All prices are per month; quarterly plans are billed once per quarter at 3× the monthly rate.

You authorize Curb Critter to charge your payment method via Stripe, Inc. on the schedule described in these Terms. We do not store your full card number. Prices may change; we will notify you before any price change applies to your next renewal.

4. Free Trial

New customers may be offered a 14-day free trial:

  • Bin Valet service begins immediately upon enrollment.
  • Bin Cleaning service does not begin until after your first paid charge.
  • Your payment method is required at sign-up but is not charged during the trial.
  • Auto-conversion: unless you cancel before the trial ends, your trial automatically converts to a paid subscription at the disclosed price on the first day following the 14-day period. We will remind you before conversion.

5. Recurring Billing & Automatic Renewal

Curb Critter plans are subscriptions that automatically renew until you cancel. Before you submit payment, we clearly disclose: (a) that the plan auto-recurs; (b) the recurring price; (c) the billing period; (d) how to cancel; and (e) when cancellation takes effect.

  • Month-to-month plans renew and are billed automatically every month.
  • Quarterly plans renew and are billed automatically every three (3) months.

6. Cancellation

You may cancel at any time through your account portal or by emailing hello@curbcritter.com. Cancellation takes effect at the end of your current paid billing period. There is no cancellation fee. We do not require you to call to cancel.

  • Cancellation before renewal date: plan will not renew; service continues through the end of the paid period.
  • Cancellation mid-period: you are not charged again after the current period ends; the current period is not shortened or refunded.
  • Pausing: contact us if you need a temporary pause — pause options may be available and are not treated as a cancellation.

7. Refunds

Because Curb Critter delivers a physical, labor-based service on a recurring schedule:

  • Bin Valet: charges are earned as valet visits are performed across the billing period. If you cancel mid-period, service already performed is not refunded; we do not charge again after the period ends.
  • Bin Cleaning: performed once per billing period. If your cleaning for the current period has already been completed when you cancel, that charge is fully earned and non-refundable. If cleaning has not yet been performed, we may, at our discretion, refund or waive the unearned cleaning charge.

Nothing in these Terms limits refund rights required by applicable law.

8. Property Access & Customer Responsibilities

You authorize Curb Critter and its Service Providers to access your property as needed to provide the Services. You are responsible for:

  • Keeping gates, side-yard access, and bin storage areas unlocked, unobstructed, and safe on your scheduled service day(s).
  • Restraining pets during scheduled service windows.
  • Ensuring bins are in working condition and free of hazardous materials.
  • Providing accurate address, gate code, and access instructions, and promptly updating us if they change.

If we cannot safely access your property on a scheduled day, that visit is treated as attempted service and is not refunded.

9. Independent Service Providers

Bin Valet services are performed by Curb Critter directly and/or by independent zone partners who are independent contractors, not employees or agents of Curb Critter. Bin Cleaning is performed by Curb Critter and/or independent third-party cleaning vendors. References to “we” performing a service include performance through these independent Service Providers under our brand and service standards.

10. Limitation of Liability

You must notify us in writing of any claimed property or bin damage within seventy-two (72) hours of the service date, with available photos or details, or the claim is waived.

To the fullest extent permitted by law, Curb Critter’s total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim. Curb Critter is not liable for indirect, incidental, consequential, special, or punitive damages.

THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED IN THESE TERMS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify and hold Curb Critter, its owners, employees, and Service Providers harmless from any third-party claim arising from your breach of these Terms, your violation of law, or your provision of false or unauthorized property-access information, except to the extent caused by our own negligence or misconduct.

12. Weather, Access Failures & Force Majeure

We are not liable for delays or missed visits caused by severe weather, natural disaster, government or waste-hauler schedule changes, denied or unsafe property access, or other events reasonably outside our control. We will make reasonable efforts to reschedule affected visits.

13. SMS / Text Messaging Terms

Program name: Curb Critter Service Notifications

If you provide a mobile number and opt in at sign-up, Curb Critter may send you transactional SMS text messages including service day reminders, route completion alerts (bins placed out or returned), and account or billing notifications.

Message frequency: varies — typically 2–4 messages per service week.

Message & data rates may apply. Contact your mobile carrier for details.

Reply STOP at any time to opt out of all SMS messages from Curb Critter.

Opting out of texts does not cancel your subscription — to cancel service, follow Section 6 above.

Your mobile number is never sold or shared with third parties for their own marketing.

14. Referral Program

Curb Critter may operate a referral program under which independent third parties earn a fee for referring new customers. Referral partners are independent contractors, not our employees or agents, and have no authority to bind us to any offer or vary these Terms. Any discount mentioned by a referral source is valid only if confirmed on our website or at checkout.

15. Platform License & Intellectual Property

15.1 Limited License to Use the Platform

Subject to your compliance with these Terms and maintenance of an active paid subscription, Curb Critter LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Curb Critter customer portal, website, and any associated mobile applications (collectively, the “Platform”) solely for your own personal, non-commercial use in connection with the Services described in Section 2. This license does not transfer any ownership or intellectual property rights to you. All rights not expressly granted are reserved by Curb Critter LLC.

15.2 Ownership of Technology

The Platform — including the Curb Critter website, customer portal, driver mobile application, route-optimization engine, proprietary scheduling and dispatch software, administrative dashboard, and all software, algorithms, source code, object code, databases, workflows, and related documentation — constitutes valuable trade secrets and proprietary technology owned exclusively by Curb Critter LLC or its licensors. The Curb Critter name, logo, mascot, trade dress, and all other brand elements are trademarks of Curb Critter LLC. Nothing in these Terms grants you any right, title, or interest in any of the foregoing.

15.3 Prohibited Uses

You agree that you will not, and will not permit any third party to:

  • Copy, reproduce, distribute, publish, display, or create derivative works of any part of the Platform or its content without our prior written consent.
  • Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive or access the source code, underlying algorithms, architecture, or trade secrets of the Platform or any component thereof.
  • Scrape, spider, crawl, or use any automated tool to extract, collect, or harvest data or content from the Platform.
  • Sell, resell, sublicense, rent, lease, transfer, or otherwise commercially exploit access to the Platform or the Services to any third party.
  • Use the Platform to develop, directly or indirectly, a competing product or service, or to benchmark the Platform for competitive purposes.
  • Remove, obscure, or alter any proprietary notices, labels, or marks on the Platform.
  • Circumvent, disable, or otherwise interfere with security-related features of the Platform, including features that limit or restrict use or copying of any content or that enforce limitations on use.
  • Access the Platform by any means other than the interfaces we expressly provide, or attempt to gain unauthorized access to any part of the Platform, its servers, or related systems.

15.4 Feedback

If you provide us with any feedback, suggestions, or ideas about the Platform or Services (“Feedback”), you grant Curb Critter a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and commercialize that Feedback in any way without obligation or compensation to you.

16. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your state of residence apply. Any dispute arising out of these Terms or the Services shall first be attempted to be resolved informally by contacting us at hello@curbcritter.com.

17. Changes to These Terms

We may update these Terms from time to time. If a change materially affects price or your renewal terms, we will notify you by email before it takes effect on your next renewal. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.

18. Termination

We may suspend or terminate service for non-payment, violation of these Terms, unsafe conditions for our Service Providers, or provision of false information, with notice where reasonably practicable. You may terminate at any time under Section 6.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy and your order details, are the entire agreement between you and Curb Critter regarding the Services and supersede prior agreements on the subject.
